Canadian citizenship accords individuals with certain rights and freedoms and imposes some obligations.

The naturalization rate in Canada is the highest among other nations in the world; thus, almost 85% of eligible permanent residents become citizens.

ATTRIBUTES OF CANADIAN CITIZENSHIP

  • Right to enter and remain in Canada
    • Among the other privileges Canadian Citizens enjoy the right to enter and remain in Canada, which means that officers at the port of entry may not refuse a person’s admission if they establish that the person is a Canadian citizen.
  • Multiple citizenships
    • Canada allows a person who becomes a citizen of Canada to retain any previous citizenship. However, this is subject to the other country’s law, which may choose to revoke the citizenship of those who acquire citizenship elsewhere.
  • Rights of Canadian Citizenship

APPLYING FOR CANADIAN CITIZENSHIP

To apply for a Grant of Citizenship (Naturalization), an applicant must meet the following criteria:

  • Lawful admittance to Canada as a permanent resident
  • No loss of permanent residency
  • Residence in Canada:
  • At least three years (1,095 days) out of the past five years.
  • File a return of income for each of the taxation years. The return of income must be fully or partially within five years immediately before the date of applying).
  • Demonstrate an understanding of the responsibilities of the citizenship test (18 to 54 years of age).
  • The test has twenty 20 questions, and the pass mark is 75% (15 out of 20 questions correctly answered)
  • An applicant with difficulties meeting the language and/or knowledge requirements due to physical and/or mental health challenges may request a waiver of the conditions on compassionate grounds and on a case-by-case basis.

Very often, permanent residents and foreign nationals become inadmissible to Canada due to their past mistakes, omissions, and or failure to meet the obligations of their permanent resident status under the Immigration, Refugee, and Citizenship Act.

The consequences of inadmissibility are often severe and detrimental to the foreign national or permanent resident. They can include a Canada Border Services Agency issuing a removal order to the foreign national or a permanent resident to leave Canada immediately or detaining the foreign national or permanent resident pending the outcome of an appeal hearing or until their removal from Canada.

The following are grounds on which a person can be denied entry to Canada include:

Provincial nomination offers a great opportunity for immigrants to attain permanent residence in Canada.

Canadian immigration laws provide provinces and territories to develop their immigration programs to allow a fair share of new immigrants required for the labour market. Canadian Provinces and Territories can nominate immigrants with the skills, education, and work experience needed to contribute to the economy of the particular province or territory under the Provincial Nominee Programs (PNP). The potential immigrants must want to live there.

Each province and territory facilitates its own “streams” (immigration programs that target specific groups) and criteria for its PNP. The targeted groups may be students, business people, skilled workers, or semi-skilled workers in a program stream.

Since January 1, 2015, several provinces and territories have launched new Express Entry streams.

Requirements

  • Candidates must demonstrate an Intent and ability to become economically established in the province of application by joining the labour market full-time.
  • Candidates must secure a full-time permanent job offer in an eligible occupation (if applicable)
  • Candidates must demonstrate that they have sufficient settlement funds
  • Candidates must have the appropriate qualifications, training, and skills accreditations for the job.
  • Candidates require CLB 5 or higher for an occupation in NOC 0, A, and B.
  • Candidates require CLB 4 ( mandatory test results) for an occupation in NOC C, D.
  • The candidate must have legal status in the country of current residence
  • Labour Market Impact Assessment (LMIA) may be required
  • An expression of interest may be required.

The Self-Employed Person Program allows applicants who want to immigrate to Canada permanently as self-employed persons to make significant contributions to Canada’s cultural or athletic life.

Interested applicants must demonstrate that they meet the following eligibility criteria:

  • Relevant experience in cultural activities or athletics, and
  • Be willing and able to be self-employed in Canada
  • Meet the program’s selection criteria, and
  • Meet medical, security, and other conditions

RELEVANT EXPERIENCE

The applicants’ experience is relevant if they have the following:

  • Taken part in cultural activities or athletics at a world-class level or
  • Have been a self-employed person in cultural activities or athletics

EXPERIENCE TIME

  • Relevant experience for a self-employed person must be at least two 1-year periods of full-time work experience in an eligible role in the last five (5) years.

For Cultural activities:

  • 2 one-year periods being self-employed in cultural activities, or
  • 2 one-year periods participating at a world-class level in cultural activities, or
  • a combination of a one-year described in (a), and a one-year described in (b)

For Athletics:

  • 2 one-year periods being self-employed in athletics, or
  • 2 one-year periods participating at a world-class level in athletics, or
  • a combination of a one- year described in (a) above and a one-year period described in (b) above.
